Labor & Employment Update: Employee Retaliation Claims Become Easier to Make

As we have often counseled, employers must be extraordinarily careful about how they treat those who charge discrimination, or those who have supported discrimination allegations. While the initial charge often proves baseless, employers and supervisors, troubled by the initial accusations, often treat the complainant and his or her supporters differently. This leads to retaliation claims. Last week, the United States Supreme Court expanded the scope of people protected by the anti-retaliation laws.
