New Nursing Home Regulations Regarding Hospice

The Department of Health and Human Services recently issued final regulations, which take effect on August 26, 2013, imposing specific regulatory requirements on nursing homes who arrange for hospice services for their residents. Prior to these regulations, hospices shouldered the majority of the regulatory burden for specific requirements with respect to providing care in nursing homes.
While these new nursing home regulations closely track the hospice regulations, the final rule highlights nursing homes’ responsibility for ensuring the quality of hospice services. In addition, changes to written agreements between nursing homes and hospices may be required. A failure to meet these requirements will be cited under F309. The final regulations can be found here.
