Massachusetts Proposes Changes to Biomass Regulation

On September 17, 2010, the Massachusetts Department of Energy Resources ("DOER") issued a proposed draft regulation to implement proposed changes to biomass eligibility for the Massachusetts Renewable Energy Portfolio Standard ("RPS") program ("Proposed Biomass Regulation"). The proposed regualtions come in the form of revisions to the existing RPS regulations, 225 CMR 14.00 ("RPS Regulations").
The Proposed Biomass Regulations significantly change the elibibility requirements associated with "woody" fuel sources.
