The Attorney General Finalizes Emergency Regulations and Issues Guidance Interpreting the New Open Meeting Law

Developers of everything from large-scale commercial developments to single family residential construction and anyone in the process of seeking municipal approvals should familiarize themselves with the revisions to the Open Meeting Law, which took effect on July 1, 2010. The final regulations at 940 CMR 29.00, et seq., took effect on October 1, 2010. The Attorney General's Office has released a Guidance document explaining how the AG will interpret some of the provisions that raised the most concern and confusion during the public comment period. This article provides a summary of the major changes to the Open Meeting Law that will affect the ways in which municipal boards must conduct their meetings, including those at which applicants seek to obtain zoning permits and other approvals.
