Benjamin H. Nissim
Benjamin Nissim is an Associate in the firm’s Litigation Department and is a member of the firm’s Insurance Recovery, Bankruptcy and Creditors’ Rights, and Privacy and Cybersecurity practice groups. Ben represents a variety of clients, including individuals, closely held corporations, and Fortune 100 businesses in complex commercial disputes. His experience includes providing counsel on and litigating insurance and reinsurance coverage issues, contract disputes, business torts, and professional negligence claims. He regularly litigates matters in state and federal courts, arbitration, and in appellate proceedings.
Ben’s work frequently involves representing investors, businesses, and officers and directors in high-stakes litigation involving breach of fiduciary duty and fraud claims arising out of the management of companies in the retail, manufacturing, and financial services industries. Ben also provides counsel on and litigates insurance coverage issues under Property/Casualty, D&O, E&O, and Cyber Insurance policies, with a particular emphasis on long-tail environmental and asbestos claims, construction and surety losses, high deductible and retrospectively rated plans, and bad faith claims. He also has significant experience litigating reinsurance coverage issues, having helped secure multiple seven figure results for his clients.
Ben is involved in a number of appellate proceedings, including briefing issues arising out of environmental and property damage and insurance coverage disputes at the Connecticut Appellate Court. This work has also included his recently arguing a matter involving such property damage at the Appellate Court.
In addition, Ben frequently represents secured and unsecured creditors in bankruptcy and bankruptcy-related litigation. Amongst other things, he has prosecuted and defended avoidance actions and non-dischargeability complaints in contested matters and adversary proceedings. Ben also has extensive experience providing strategic counsel to clients on issues arising out of state insurer rehabilitation and liquidation proceedings, including the effectiveness of contract novations as to policyholders pursuant to assumption reinsurance agreements and the impact of setoffs in liquidation on international reinsurance pool participants.
As a member of the Firm’s Privacy and Cybersecurity Practice Group Ben also advises companies and individuals on cybersecurity and data protection issues and writes and presents on emerging issues in cybersecurity and data protection regulation, with a particular emphasis on cyber insurance coverage.
Ben maintains a robust pro bono practice. He has worked with Lawyers for Children America, representing children throughout neglect proceedings involving the Connecticut Department of Children and Families. He has also represented multiple incarcerated individuals in claims arising out of their conditions of confinement.
Ben received his J.D., magna cum laude, from the University of Notre Dame Law School. While in law school, he was the Executive Editor of the Journal of Law, Ethics and Public Policy. During Law School, Ben was a Judicial Intern for Magistrate Judge William I. Garfinkel of the United States District Court for the District of Connecticut. Ben received his B.A. from Wesleyan University.
