October 2014 - Construction Law Seminar: NEW RETAINAGE LAW Effective November 6, 2014
Last month, Massachusetts enacted an act "Relative to Fair Retainage Payments in Private Construction." The act limits the amount of retainage to five percent and establishes specific close out procedures at the end of a project. Failure to comply with the act's requirements can have serious consequences. The act applies to private construction contracts where the prime contract is over $3 million and is signed after November 5, 2014.
